Terms of Use

1. Acceptance of Terms

By accessing or using IBM Storage Field Companion (“the Application”), you agree to be bound by these Terms of Use. If you do not agree, you must not access or use the Application. These terms apply to all users of the Application.

2. Eligibility and Permitted Users

The Application is available exclusively to current IBM employees with valid IBM w3id credentials. You must not share your account, credentials, or access with any other party. Access is provided for IBM business productivity purposes only.

If your IBM employment ends, your access to this Application is automatically revoked when your IBM w3id credentials become inactive.

3. Permitted Use

You may use the Application to:

• Manage your IBM Storage customer account information for sales and pre-sales purposes
• Access IBM Storage product knowledge for customer engagements
• Receive AI-generated intelligence summaries about publicly traded or publicly notable companies
• Prepare for customer meetings and track follow-up items
• Configure your digest timezone and notification preferences via your profile settings

You must not:

• Share access with non-IBM employees or use the Application for personal non-IBM business
• Enter highly sensitive personal data, payment card information, or government-classified information
• Use the Application in violation of IBM's internal data handling policies or Business Conduct Guidelines
• Attempt to reverse-engineer, scrape, or disrupt the Application
• Forward IBM Internal content generated by this Application to external parties
• Use AI-generated content from this Application as authoritative fact without independent verification

4. AI-Generated Content Disclaimer

The Application uses AI services (IBM watsonx, Groq) to generate summaries, briefings, and intelligence analysis. AI-generated content is provided for informational purposes only.

• AI-generated content may be inaccurate, incomplete, or outdated.
• It does not constitute legal, financial, business, or professional advice.
• You are solely responsible for verifying AI-generated content before relying on it in customer conversations or business decisions.
• AI summaries are based on publicly available news signals and do not represent IBM's official intelligence or research.
• The Application administrator is not liable for any decisions made based on AI-generated content.

5. Data Responsibility

You are responsible for the accuracy and appropriateness of data you enter into the Application. By entering customer information, you represent that:

• You have a legitimate IBM business reason to record and access this information
• The information is handled in accordance with IBM's data classification and handling policies
• You will not enter information that you do not have the right to store digitally
• You will treat Customer Confidential data with appropriate care

6. Not an Official IBM Product

IBM Storage Field Companion is a personal productivity tool built by an IBM employee. It is not:

• An official IBM Corporation product or service
• Endorsed, sponsored, or approved by IBM Corporation
• Supported by IBM IT, IBM Legal, or IBM Security teams
• Subject to IBM's standard SLA or data retention guarantees
• A replacement for IBM-provided official tools (e.g., Salesforce CRM, IBM FindCMR)

Use of this Application does not relieve you of obligations to record required information in IBM's official systems of record.

7. Disclaimer of Warranties

THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. THE ADMINISTRATOR DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION ADMINISTRATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE ADMINISTRATOR'S TOTAL LIABILITY TO YOU EXCEED ZERO DOLLARS ($0), AS THIS IS A FREE INTERNAL TOOL PROVIDED WITHOUT CONSIDERATION.

9. Indemnification

You agree to indemnify and hold harmless the Application administrator from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Application, your violation of these Terms, or your violation of any third-party rights or IBM policies.

10. Intellectual Property

IBM trademarks, logos, and product names referenced in the Application are the property of IBM Corporation and are used for identification purposes only. This Application is not affiliated with or endorsed by IBM Corporation. The Application code and custom content created for this tool remain the property of the developer. You may not reproduce or redistribute Application content outside of IBM internal use.

11. Third-Party Services

The Application integrates with third-party services (IBM watsonx, Groq, Tavily, AWS SES). Your use of the Application constitutes acceptance of those services' terms and policies to the extent data is transmitted to them as described in the Privacy Policy. The administrator is not responsible for the availability, accuracy, or data handling of third-party services.

12. Termination

The administrator may suspend or terminate your access to the Application at any time, with or without notice, for any reason including violation of these Terms. You may stop using the Application at any time. Upon termination, your right to use the Application ceases immediately. Provisions of these Terms that by their nature should survive termination will do so.

13. Changes to These Terms

These Terms may be updated at any time. The “Last updated” date at the top indicates the most recent revision. Continued use of the Application after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which the administrator resides, without regard to conflict of law principles. Any disputes shall be resolved through good-faith discussion before pursuing formal proceedings.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the administrator regarding the Application and supersede any prior agreements or understandings.
